The Service is provided by TRADE JUICE D.O.O., Dimitrija Milovanovi\u0107 br. 2, 11412 Belgrade \u2013 Mladenovac, Serbia, reg. no. 21657875, PIB 112359141 (the \u201cCompany\u201d).<br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 1.2 These Terms, together with the Pricing &amp; Subscription Policy, Privacy Policy, and any other documents expressly referenced herein, form a binding contract between you and the Company.<br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 1.3 By accessing or using the Service, you (\u201cCustomer\u201d or \u201cEnd User\u201d) accept these Terms in full and agree to comply with all applicable laws and regulations of the Republic of Serbia.<br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 1.4 If you do not agree to these Terms, you must immediately discontinue use of the Service.<br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 1.5 The Company\u2019s operations under these Terms are primarily governed by:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the Law on Electronic Commerce<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the Law on Obligations<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the Law on Copyright and Related Rights<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the Law on Personal Data Protection<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the Law on Consumer Protection<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">and other applicable Serbian regulations not expressly preempted above.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\">\u00a0<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">1.6 The Company is committed to protecting personal rights, privacy, data protection, and intellectual property in accordance with good business practices and Serbian law.<br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 1.7 The Service is provided \u201cas-is.\u201d It does <\/span><b>not<\/b><span style=\"font-weight: 400;\"> constitute professional education, certification, or licensing. The Company issues no certificates, diplomas, or attestations.<br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 1.8 The Company assumes no responsibility or liability for any content, data, or materials uploaded by Customers or End Users (\u201cUser Content\u201d). User Content remains the sole responsibility of the person who uploads it. The Company may, at its discretion, create or modify content as part of the Service.<br \/><\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 1.9 The Company reserves the right to remove or disable access to any content or feature of the Service at any time, without notice or liability.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/p><h3><b>2. INTEGRITY OF THE SERVICE<\/b><\/h3><p><span style=\"font-weight: 400;\">2.1 <\/span><b>Nature of the Service.<\/b><span style=\"font-weight: 400;\"> The Service is a cloud-based software-as-a-service platform for fitness and nutrition professionals. All features, data, and content are delivered digitally; the Company does not distribute any physical media.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 2.2 <\/span><b>User Content.<\/b><span style=\"font-weight: 400;\"> Any text, images, comments, or other materials you upload or generate through the Service (\u201cUser Content\u201d) must be accurate, lawful, and free from defects (e.g., viruses). You are solely responsible for its legality, reliability, and appropriateness.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 2.3 <\/span><b>Timekeeping.<\/b><span style=\"font-weight: 400;\"> All dates, deadlines, time zones, and non-working days referenced by the Service follow Serbian law and Central European Time (CET), unless otherwise indicated.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 2.4 <\/span><b>Misuse.<\/b><span style=\"font-weight: 400;\"> Any use of the Service that violates these Terms (including unauthorized access, misuse of credentials, or infringement of rights) constitutes a material breach and may result in suspension or termination of your account.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 2.5 <\/span><b>Account Security.<\/b><span style=\"font-weight: 400;\"> You choose your password at registration and are responsible for maintaining its confidentiality. Do not share your credentials or access someone else\u2019s account. Promptly notify the Company of any unauthorized access or security breach.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 2.6 <\/span><b>Protection of Rights.<\/b><span style=\"font-weight: 400;\"> The Company will, upon receipt of a duly-supported request that alleges infringement of personal, privacy, or intellectual property rights, remove or disable access to the infringing User Content and cooperate with legal authorities as required under Serbian law.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 2.7 <\/span><b>Electronic Communications.<\/b><span style=\"font-weight: 400;\"> The Company acts solely as a conduit for electronic messages initiated by Customers and End Users. The Company does not (a) initiate transmissions, (b) select data for transmission, (c) alter message content, or (d) choose message recipients.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><span style=\"font-weight: 400;\"> 2.8 <\/span><b>Modifications &amp; Suspension.<\/b><span style=\"font-weight: 400;\"> The Company may modify, suspend, or discontinue any aspect of the Service (features, content, support) at any time, with or without notice, so long as it follows good business practices.<\/span><\/p><h3>\u00a0<\/h3><h3><b>3. DESCRIPTION OF THE SERVICE<\/b><\/h3><p><b>3.1 Definitions<\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>\u201cPlatform\u201d<\/b><span style=\"font-weight: 400;\"> means Fit Beat\u2019s web- and app-based software environment, including all user interfaces, APIs, dashboards, and related documentation.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>\u201cService\u201d<\/b><span style=\"font-weight: 400;\"> means the subscription-based SaaS offering that the Company makes available via the Platform, comprising all features listed in Section 3.3 below.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>\u201cCustomer\u201d<\/b><span style=\"font-weight: 400;\"> means any individual or legal entity who has registered for and paid for a subscription to use the Service.<\/span><span style=\"font-weight: 400;\"><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>\u201cEnd User\u201d<\/b><span style=\"font-weight: 400;\"> means any natural person for whom a Customer creates an account or otherwise uses the Service.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/li><\/ul><p><b>3.2 Service Delivery<\/b><b><br \/><\/b><span style=\"font-weight: 400;\"> The Service is delivered entirely online as software-as-a-service. Customers access the Service over the internet\u2014no local installation is required. All data, configurations, and content created within the Platform are stored securely in the Company\u2019s cloud infrastructure.<\/span><\/p><p><b>3.3 Core Features<\/b><b><br \/><\/b><span style=\"font-weight: 400;\"> Fit Beat provides an all-in-one solution for fitness and nutrition professionals. We may add, modify or remove features at our discretion \u2014 provided that any <\/span><b>material<\/b><span style=\"font-weight: 400;\"> downgrade in functionality is communicated to Customers at least 30 days in advance.<\/span><\/p><h2>\u00a0<\/h2><h2><b>4. TYPES OF USERS<\/b><\/h2><p><b>4.1 Visitor<\/b><b><br \/><\/b><span style=\"font-weight: 400;\"> A \u201cVisitor\u201d is anyone who browses Fit Beat\u2019s public pages without registering or paying. Visitors may view marketing materials, help articles, and publicly-shared demo content.<\/span><\/p><p><b>4.2 Customer<\/b><b><br \/><\/b><span style=\"font-weight: 400;\"> A \u201cCustomer\u201d is any individual or legal entity that registers for, and pays, a subscription to use the Service. You agree to promptly update any changes to your contact or billing information.<\/span><span style=\"font-weight: 400;\"><br \/><\/span> <b>5.3 Credentials.<\/b><span style=\"font-weight: 400;\"> You are solely responsible for maintaining the confidentiality of your login credentials. You agree not to share them or allow unauthorized access.
